1. Who we are

This website and the Nimda Tech brand are operated by WINDUP BIRD LIMITED, a company registered in New Zealand (Company № 1927855, NZBN 9429033486000, GST 96489374), with its registered office at Level 5, 110 Symonds Street, Auckland 1010, New Zealand. In this policy, "Nimda Tech", "we", "us" and "our" refer to WINDUP BIRD LIMITED.

We are responsible for the personal information collected through this website. This policy explains what we collect, why, and the choices you have. We handle personal information in line with the New Zealand Privacy Act 2020 and, where it applies, the EU and UK General Data Protection Regulation (GDPR).

2. Data we collect

Contact and proposal forms. Your name, work email, company name, website, phone or messenger handle, vertical, traffic sources of interest, monthly ad budget and any message you send us.

Job applications. Your name, email, phone or Telegram handle, the position you apply for, LinkedIn or portfolio URL, years of experience, cover letter, and the CV you upload, including any information it contains about your education and work history.

Cookies and usage data. Technical information such as IP address, browser type, device, pages visited and referring URL, collected through essential cookies and, with your consent, analytics cookies.

We do not intentionally collect sensitive information. Please do not include details such as health information in your CV or messages.

3. How we use data

  • To respond to your enquiry and prepare a proposal for our services.
  • To assess job applications, contact candidates and run our recruitment process.
  • To provide, operate and secure this website.
  • To understand how the website is used and improve it, where you have consented to analytics cookies.
  • To meet our legal, accounting and regulatory obligations.

We do not sell your personal information, and we do not use form or application data for automated decision-making.

5. Data sharing

We share personal information only when needed, with:

  • Service providers who host our website, process form submissions, store files, send email or provide analytics, under contracts that require them to protect your data.
  • Professional advisers such as lawyers and accountants, where necessary.
  • Authorities, where required by law or to protect our legal rights.

6. Data retention

We keep enquiry and proposal data for up to 24 months after our last contact, unless you become a client, in which case contract records are kept for as long as the law requires.

Job applications and CVs are kept for up to 12 months after the recruitment process ends, so we can contact you about future roles. You can ask us to delete your application earlier at any time.

7. International transfers

We work with advertisers and team members worldwide, so your information may be processed outside New Zealand or your own country. When we transfer personal information, we take reasonable steps to make sure it is protected by comparable safeguards, such as standard contractual clauses or providers in countries with adequate privacy laws.

8. Your rights

Depending on where you live, you may have the right to:

  • Access the personal information we hold about you and ask us to correct it.
  • Ask us to delete your information or restrict how we use it.
  • Object to processing based on legitimate interests.
  • Receive a copy of your information in a portable format.
  • Withdraw consent, for example for analytics cookies.
  • Complain to the Office of the Privacy Commissioner in New Zealand or your local data protection authority.

We respond to requests within 20 working days.

9. Cookies

Essential cookies make the website work, for example remembering your cookie choice and your preferred color theme. They cannot be switched off.

Analytics cookies help us understand how visitors use the site. They are only set if you click "Accept" in the cookie banner.

You can change your choice at any time by clearing cookies for this site in your browser, which will show the banner again.
